Introduction

Welcome to Trade Scouts Privacy Policy and General Terms of Service (“Our Terms”). Our website and associated services are designed to help Job Seekers create and manage their Trade Scouts Multimedia Portfolio, search for job openings, and connect with potential Employers. Our platform also serves as a tool for Employers to post job openings and find qualified Job Seekers for their open positions.

By using our website, you agree to the policies outlined in Our Terms. This document provides an overview of our data collection practices, how we use and protect the information you provide, and your rights as a user of our services.

p> Please note that we reserve the right to remove data, terminate accounts, and use content as needed without notice. Our site is intended for use by Job Seekers, Employers, and Staffing Agencies in the United States.

Definitions

Types of Authorized Users

  • Job Seekers are those who are actively seeking employment opportunities. In this policy, Job Seekers are defined as people who use the Trade Scouts websites to create Multimedia Portfolios and search for job openings. Job Seekers are not contractors or employees of Trade Scouts.
  • Employers are organizations or companies that are using Trade Scouts and the Trade Scouts website to post job openings and find qualified Job Seekers to fill various open positions. Employers may partner with Staffing Agencies that also use the platform to hire talent. Trade Scouts does not lease Job Seekers to Employers, and any employment arrangement is between the Staffing Agency and Employer or Job Seeker and Employer.
  • Staffing Agencies are organizations or companies that are using Trade Scouts and the Trade Scouts website to connect Job Seekers with Employers. Staffing Agencies may hire Job Seekers and place them with Employers. Staffing agencies are not contractors or employees of Trade Scouts.

Trade Scouts is the name of this website (“Site”), cloud-based software and any associated services provided to Authorized Users by the Trade Scouts team. These services are designed to help Job Seekers first create and then manage their Trade Scouts Multimedia Portfolio, as well as facilitate connections between Job Seekers, Staffing Agencies and potential Employers.

A Trade Scouts Multimedia Portfolio (for Job Seekers) is a collection of someone's talents that uses mediums like photos and videos to communicate experience. Job Seekers create their multimedia portfolio on the Trade Scouts website. It may include a range of information, including education, work experience, skills, and job preferences, as well as documentation and media (e.g., licenses, photos, background check results, proof of insurance, certifications, work authorization documents, videos, etc.) supplied by Job Seeker to back up that information. Trade Scouts Multimedia Portfolios helps match Job Seekers with job openings from potential Employers.

A Third Party is hereby defined as any organization or company that is not directly involved with Trade Scouts, Employers, or Job Seekers. A third party may, for example, be an external job board or third-party website, or service providers discussed on the site, such as lumber, tool and equipment retailers.

A Vendor is a type of Third Party that is paid by Trade Scouts to provide business support in areas such as maintaining the Trade Scouts website, payment processing or data storage.

An Affiliate is a person or organization that does business with Trade Scouts and is promoted by Trade Scouts. Trade Scouts may sell or promote affiliate products or services on Trade Scouts' online platform.

A Partner is a person or organization that promotes the use of Trade Scouts (e.g. a referral partner). Trade Scouts may be an affiliate of a Partner, and partners may promote Trade Scouts via social media, etc.

Personal Data is any information that relates to an identified or identifiable natural person. This can include a person's name, address, phone number, email address and can include information about how one engages with Trade Scouts employment hiring platform as well as IP addresses.

The Job Seeker Portfolio houses basic information about Job Seeker such as name, preferred work location and contact information, as well as work history, professional references and other job related information. Job Seeker Portfolio information is typed by Job Seeker into preexisting fields that are are keyword or category searchable by Employers and Staffing Agencies.

A virtual Hiring Event is triggered when either an Employer or Staffing Agency posts a job ad on the Trade Scouts online job board. The virtual hiring event encompasses all aspects of the hiring process within the Trade Scouts platform as it relates to a specific job opening. This includes, for example, the job listing or job ad, job-specific screening questions, candidate correspondence, and candidate Multimedia Portfolio access.

Terms of Service for Job Seekers

Job ads or Job listings

Trade Scouts offers job ads, descriptions, and related content. This may include links to third- party websites. This service is free for Job Seekers, but Trade Scouts may receive compensation from Employers and other third parties (excluding Vendors) who use Trade Scouts.

Trade Scouts has no control over the content or conditions of job ads provided by third-party sources. Job Seekers may encounter third-party websites that have their own terms and conditions. Trade Scouts has no responsibility or liability for ads, information, and links going out of its site. Trade Scouts can exclude or remove job ads from the site with no explanation and has no obligation to present all job ads to users.

Trade Scouts may collect information about job openings or opportunities initiated through third- party websites, including job listings viewed and job posting-related activity. Employers using tracking functionality are responsible for providing required notices and obtaining necessary consent, but Trade Scouts has no control over these third-party websites.

Trade Scouts provides independent functionality to assist Job Seekers, such as search options and mobile formatting and may promote job ads on dedicated pages or websites. However, the placement of job ads on these pages or websites does not guarantee a better job-seeking experience, interview, or job offer, and the pages do not contain an exhaustive list of job ads or Employers. Additionally, Job Seekers should be aware that telephone numbers extracted from job ads may not be correct.

Multimedia Portfolios

When you create a searchable Multimedia Portfolio on Trade Scouts, you are authorizing Trade Scouts to make it available to Employers and users of the site, as well as users who are registered with the site. By default, Multimedia Portfolios are set to searchable, but Job Seekers can choose to make them not searchable, though this may not prevent Employers from contacting them. Multimedia Portfolios set to searchable can be copied by third parties, and changes to the Multimedia Portfolio on the site may not be reflected on copies made by third parties. Trade Scouts assumes no responsibility for Multimedia Portfolios or information shared with Employers or made public.

By creating or uploading a Multimedia Portfolio on Trade Scouts, users authorize Trade Scouts to review or scan their Multimedia Portfolio and provide feedback, which is not made available to Employers. Trade Scouts may also share job ads with users that match their Multimedia Portfolio contents and highlight items in the Multimedia Portfolio that match job qualifications. Users are responsible for ensuring the accuracy of their Multimedia Portfolio and information and Trade Scouts assumes no liability for any inaccuracies or updates. Trade Scouts assumes no responsibility for any Employers’ interpretation or actions based on any Job Seekers’ Multimedia Portfolio content.

Trade Scouts may associate users' Multimedia Portfolio data with their Job Seeker Portfolio, which includes information provided in the "Multimedia Portfolio" section of their account and may be available to other authorized users, such as Employers and Staffing Agencies. To mitigate fraud, Trade Scouts may mask or hide users' contact information on their Multimedia Portfolios, and Employers and Staffing Agencies may also choose to mask their contact information. Trade Scouts may limit users' ability to set their Multimedia Portfolio to searchable at any time for reasons such as fraud mitigation. There is no guarantee that a user's Multimedia Portfolio will be shown to a particular Employer or Staffing Agency.

Any information, documentation or media added to the Trade Scouts Multimedia Portfolio by Job Seeker is done voluntarily and at Job Seeker’s own discretion and own risk. By using Trade Scouts, Job Seeker agrees they will not submit information, documentation or media which:

  • Impersonates another person or entity or misrepresents your affiliation with a person or entity;
  • Contains the private information of any third party who has not authorized the use or disclosure of that information;
  • Is commercial in nature;
  • Infrignest on a third party’s intellectual property rights;
  • Is threatening, incites violence or promotes illegal activity;
  • Promotes or endorses drug use, child pornography or other illegal activities; or
  • Contains hate speech, nudity, or graphic or gratuitous violence.

Applying to Jobs Through Trade Scouts

Multimedia Portfolios and information submitted through the Site, including personal data, are subject to Trade Scouts' Terms of Service and Privacy Policy. Once a user provides information to an Employer, Trade Scouts has no control over the Employer's use or disclosure of that information. By submitting information or a message through Trade Scouts, users authorize Trade Scouts to make their information available to the Employer or Staffing Agency and agree to automated processing by Trade Scouts.

When you upload content using Trade Scouts, Trade Scouts will attempt to send your information to the contact information provided to us by an Employer or Staffing Agency However, Trade Scouts cannot guarantee that such messages and information will be delivered, received, accessed, read or acted upon, and we are not responsible for expired job opportunities or for delivering information prior to a job opportunity’s expiration.

Trade Scouts is not responsible for the content or format of job postings, messages, questions, or assessments sent by Employers or Staffing Agencies and does not guarantee receipt of your information or messages from the Employer or Staffing Agency. Employers and Staffing Agencies are solely responsible for compliance with applicable laws, and Trade Scouts cannot guarantee the identity of an Employer or Staffing Agency or the safety measures taken during the hiring process.

Trade Scouts does not guarantee the validity of a job offer and advises Job Seekers to verify it before taking any action. We do not develop screener questions associated with job postings or offers, and the user agrees not to hold Trade Scouts accountable for any screener questions. By using Trade Scouts and answering screener questions, you acknowledge that Employers or Staffing Agencies may have instructed Trade Scouts to send out rejection notices, and you acknowledge that Trade Scouts has no discretion in transmitting these rejections.

By using Trade Scouts, you acknowledge that Employers or Staffing Agencies may have instructed Trade Scouts to schedule interviews with Job Seekers and that the decision of who to interview is solely made by the Employer. When you search for jobs on Trade Scouts, Trade Scouts may suggest information from your portfolio to include in your application, and as part of its efforts to combat fraud and spam, Trade Scouts may require users to verify their email addresses and Cell phone numbers.

By accessing or using Trade Scouts, Job Seekers agree to hold Trade Scouts harmless for any claims arising from Job Seekers’ interactions with Employers, Staffing Agencies, or Third Parties.

Job Matching and Recommended Jobs

Trade Scouts provides job matches to Job Seekers and Employers based on data collected through the Site, such as job ads, Multimedia Portfolios, and activity on Trade Scouts. These recommendations are presented in various formats and are subject to Trade Scouts' terms of service.

Trade Scouts will send all matching Multimedia Portfolios to Employers or Staffing Agencies who have posted a job. Employers or Staffing Agencies will be able to review those Multimedia Portfolios. Job Seekers may receive communications from Employers or Staffing Agencies as a result of this process.

By using Trade Scouts, you, as a Job Seeker, understand that your Multimedia Portfolio may be sent to Employers if your Multimedia Portfolio matches a job posting. You agree that if this match occurs, your Multimedia Portfolio and all information contained in your Multimedia Portfolio will be made available to Employers, Staffing Agencies, and, potentially, associated third parties. Trade Scouts may also, at its own discretion, send your Multimedia Portfolio even if a match has not occurred for Employer, Staffing Agency, and third-party education. If the Employer or Staffing Agency,, after viewing your Multimedia Portfolio, wishes to invite you to apply to their job, Trade Scouts will send you a text and/or an email to notify you about this opportunity.

Communications and Other Site Actions

When using Trade Scouts, you agree to the processing, analyzing, and storing of your communications and materials for data analysis, quality control, content moderation, and other purposes. Trade Scouts may inform you about an Employer's or Staffing Agency’s actions on your Multimedia Portfolio or application and may inform the Employer or Staffing Agency about your activity on the Site. Messages or notifications from Trade Scouts are provided as a courtesy and are not guaranteed to be delivered or received.

Trade Scouts uses third-party entities to complete the interviewing, vetting, and other parts of the onboarding and recruiting process. By using our site, you agree that you are okay with your data being sent to our 3rd party partners for the purpose of providing services offered through our site. This may include official pieces of documentation (e.g., W-2’s, W-9’s) that Employers request and we obtain from Job Seekers on their behalf.

Trade Scouts may send you a text message and email reminder for interviews scheduled by an Employer, and you agree to accept such text and email message reminders on your cell phone.

Trade Scouts may allow you to place calls directly to Employers or Staffing Agencies through messages related to your job search and may use your email address to create an alias email address for your communication.

Trade Scouts may enable chat or other communication options for select Employers, Staffing Agencies, or job listings and may turn off or disable chat for any Employer, Staffing Agency, Third Party, or Job Seeker anytime. You can turn off push notifications through your browser or mobile device settings. Additionally, you can unsubscribe from non-transactional messages by replying STOP.

Virtual Communications

Employers or Staffing Agencies may offer you virtual, pre-recorded, and remote communications using Trade Scouts, and you understand that Trade Scouts is not responsible for any aspect of the Virtual Interview experience, including the transmission of phone or video communications, quality of audio/visual content, data security, or data usage and restrictions. Trade Scouts is not liable for any claims arising from your use of Virtual Interviews, and you release Trade Scouts from any such claims. Trade Scouts will make commercially reasonable efforts to safeguard data housed within the Trade Scouts multi-media hiring platform; however, Trade Scouts is not responsible for information that Employers, Staffing Agencies, or Job Seekers allow to leave the platform. For example, if an Employer allows a third party to overhear a conversation with a candidate or leaves their computer screen unlocked and unattended, etc.

If an Employer enables the recording of a virtual interview, or you are given the option to pre- record one, you agree that the recording may be stored, accessed, and analyzed by Trade Scouts and the Employer. You also acknowledge that there is no protection for any information you share or data you transmit while participating in virtual interviews and that Trade Scouts assumes no responsibility for the availability or retention of any recordings.

Employers may request that Trade Scouts or third parties conduct video interviews or record phone conversations for interview purposes on behalf of the Employer. As the Job Seeker, you agree that when this happens, Trade Scouts can send video interviews or recorded phone conversations to the party requesting this information. After receiving this data, the Employer will make a decision as to whether to move forward. That decision is theirs. Trade Scouts is not responsible for the Employer’s decision, the content of the interview or the phone recording and will not be held accountable for any adverse consequences of this chain of events.

Screening Tools

Trade Scouts offers screening tools to Employers for use in their application process, and as a Job Seeker, you agree that the Employer determines which questions are asked and which answers qualify a Job Seeker. Trade Scouts does not act as an employment agency, and the content of any screening tools, any requests for interviews or offers made, and any issues arising from the use of screening tools are the sole responsibility of Employers, Staffing Agencies, or Job Seekers.

Trade Scouts is not liable for any adverse events or consequences arising from your virtual interviews or correspondence between job Job Seekers, Staffing Agencies, and potential Employers.

Career Services

Trade Scouts offers Career Services such as Multimedia Portfolio review, live video consulting sessions, writing services, and general career guidance. By using these services, you agree that Trade Scouts is not acting as a job placement agency or staffing firm, and you take full responsibility for using the services or information provided.

Trade Scouts owns all rights in Career Services and provides you with a limited, non-exclusive, non-assignable, and non-sublicensable right and license to use materials developed by Trade Scouts or Trade Scouts vendors. Third-party career coaches or writers are not employees of Trade Scouts, and Trade Scouts does not guarantee the quality or effectiveness of their advice or guidance.

If you use a paid Career Services offering, you will be charged as indicated on the Site, and refunds are at Trade Scouts' discretion. For example, if Trade Scouts contracts a third party to offer a job training service for a fee if Job Seekers pre-pay for this service and are subsequently dissatisfied for any reason, Trade Scouts is not responsible for any refunds. If we provide or facilitate refunds, we do so at our discretion.

Salary and Other Info Provided by Trade Scouts

Trade Scouts provides users with salary and other information for informational purposes only, such as estimated salaries, responses to screener questions, and the likelihood of being selected for an interview, without warranty and subject to change or varying levels of accuracy. Trade Scouts may add labels or badges to Employer names or job ads for informational purposes only based on data contained within the job description and Employer-provided data, and Trade Scouts does not guarantee their accuracy.

Trade Scouts may display publicly available information about Employers on Company Pages but assumes no responsibility or liability for the content, accuracy, completeness, legality, reliability, or availability of such information and advises users to contact the Employer directly for the most accurate and up-to-date information.

Your Job Seeker Data

As a Job Seeker using Trade Scouts, you acknowledge that your activity on the site, such as job searches and information provided on your portfolio, is collected and used by Trade Scouts to suggest jobs and contact you on behalf of Employers and that Trade Scouts may also collect information about you when you apply to jobs on Employer websites that use Trade Scouts tracker functionality.

By using Trade Scouts, you agree that Trade Scouts collects, records, processes, analyzes, and stores any and all information you provide and activities you take on the Site and that this information may be shared with Employers, Staffing Agencies, and Third Parties. You agree and acknowledge that you may provide Demographic Information to Trade Scouts, which may be used to evaluate and improve Trade Scouts products and shared with Employers or Staffing Agencies, but that Trade Scouts may be required to reveal user data, including demographic data, to comply with legal obligations or governmental requests or to establish or exercise its legal rights or defend against legal claims.

Personal Background Checks

Job Seekers may voluntarily choose to purchase and order personal background checks from Trade Scouts’ third-party background check, and Job Seekers may voluntarily choose to upload their results to their Multi-Media Portfolios. Personal background checks may include employment verifications that include safety records and job performance information, reference checks, and criminal background checks. Trade Scouts makes no guarantees and is not responsible for the accuracy of background check results. Job Seekers, Staffing Agencies and Employers agree to hold harmless Trade Scouts for any claims arising from the use or interpretation of Job Seekers’ personal background check results.

You, the Job Seeker, acknowledge that it is your responsibility to provide the third-party background check service with “written instructions'' authorizing them to obtain your consumer report pursuant to the Fair Credit Reporting Act (“FCRA”), and it is the third-party background check company’s responsibility to inform you of your rights under the FCRA. Any disputes over background check results will be between the Job Seeker and the third-party background check company. You further acknowledge that by uploading your background check or consumer report results to your Multimedia Portfolio, you are voluntarily granting Trade Scouts, Employers, and Staffing Agencies access to this information. While Trade Scouts will make commercially reasonable efforts to keep information stored on the Site secure and limited to authorized users and third parties, you acknowledge that, as the individual voluntarily furnishing your own background check results, you are responsible for the privacy and security of your personal data and agree to hold Trade Scouts harmless and not seek damages from Trade Scouts for any circumstances resulting from the unauthorized access or misuse of your personal background check information.

Trade Scouts Hiring Assistance

Trade Scouts job board is a website and cloud-based software tool designed to facilitate Employer and Staffing Agency hiring processes by allowing access to various services, and Employers are responsible for complying with applicable laws, including EEO laws such as the Americans with Disabilities Act and Title VII of the Civil Rights Act, as amended, and indemnify Trade Scouts against any claims arising from their use of the product, and by using it, Employer or Staffing Agency acknowledges that Trade Scouts is not acting as an employment agency or procuring opportunities for Job Seekers.

Dispute Resolution

Users located in the United States waive their right to a jury trial in connection with any legal action or litigation related to their use of the Site. If a suit is brought against Trade Scouts and users need to pursue any legal actions, you will need to settle the suit in Baltimore County, MD. This may involve traveling at your own expense to Baltimore County, MD, to proceed.

Class Action Waiver

To use the Site and its services, you agree not to sue Trade Scouts as a class plaintiff or representative, but you retain the right to bring an individual lawsuit, including in small claims court, and your acceptance of this Agreement is necessary for your free use of the Site. If a suit is brought against Trade Scouts and users need to pursue any legal actions, you will need to settle the suit in Baltimore County, MD. This may involve traveling at your own expense to Baltimore County, MD, to proceed.

Terms of Service for Employers

Employer Accounts

The agreement, policies, and terms associated with any Trade Scouts service, including the Data Processing Agreement applies to users who create a Trade Scouts account, a Company Page, or post job listings on the Site, and Employers are responsible for the actions taken through their accounts, which are for business use and not for personal use.

Employer and Staffing Agency Services, Including Application Management and Screening Questions

Trade Scouts may allow Job Seekers to apply to your job ad by answering questions. Employers and Staffing Agencies are responsible for the content of their emails, job listings, and messages and are required to comply with all applicable laws, including minimum wage and wage transparency laws.

As an Employer, or Staffing Agency, you must ensure that your selection criteria are job-related and comply with the law and that you offer alternative methods of screening if required by the Americans with Disabilities Act or any similar law, while Trade Scouts has the right to reject or remove any job listing or any questions for Job Seekers for any or no reason and is not responsible for the delivery or storage of data.

When using Trade Scouts, you agree that it is your responsibility to provide correct contact information for Job Seekers, and if you do not feel comfortable using this function, you should contact the Job Seeker via another method; and as an Employer, you agree that you will not cause or allow a cross-border transfer of personal data from Trade Scouts to you that violates the applicable data protection laws and that Trade Scouts may collect demographic data from Job Seekers applying to your job listing, which you as an Employer have no ability, right, or entitlement to access without their permission.

When you use Trade Scouts, you allow Trade Scouts to send reminder emails to Job Seekers for interviews and to send emails indicating that your job listing matches a Job Seeker's Multimedia Portfolio. You are responsible for ensuring that your selection criteria are job-related and comply with applicable laws, including not discriminating against people with disabilities or members of any protected category.

Trade Scouts Job Seeker management tools allow Employers to connect with Job Seekers more efficiently, but Employers are solely responsible for the content of screener questions (including candidate rating systems and interview notes), any decisions regarding interviews and job offers, and any issues arising from the use of these tools. Trade Scouts may take action to reduce spam applications, but it does not verify the identity or qualifications of Job Seekers who apply to job listings, and the communications between Employers or Staffing Agencies and Job Seekers through Trade Scouts and relay functions are the responsibility of the parties involved.

When using automated phone screen products, you agree that you are only requesting Trade Scouts to send the Job Seeker a telephone number to answer your screening questions and that you are solely responsible for these questions. You also agree to indemnify and hold harmless Trade Scouts for any liability arising from the content of your Company Page, job listings, screener questions, or messages sent through the Site, and Trade Scouts may use any data from these materials for data analysis or quality control.

Trade Scouts may add labels or badges to Employer or Staffing Agency names or job ads at its sole discretion, and Employers or Staffing Agencies may request that Trade Scouts add such labels. The accuracy of any label or badge added to Employer or Staffing Agency names or job ads based on Employer-provided data is not guaranteed by Trade Scouts, and Trade Scouts reserves the right to change or remove such features at any time. Employers or Staffing Agencies using any Trade Scouts Application Programming Interface (API) are bound by the terms of this Agreement and any additional rules and policies made available by Trade Scouts, and accessing and using any API is done at the user's own risk.

Job Match

Trade Scouts provides job matches as recommendations to Employers, Staffing Agencies, and Job Seekers based on data collected through the site, including job ads, Multimedia Portfolios, applications, and user activity, and is subject to Trade Scouts' terms of service.

Salary and Other Information Provided by Trade Scouts

Trade Scouts may provide users with estimated job-related data, but these figures are for informational purposes only and are subject to change or varying levels of accuracy. Employers and Staffing Agencies are solely responsible for ensuring that their advertised pay ranges, statuses, and worker classifications comply with all applicable wage and hour and tax laws, including laws governing equal pay and pay transparency. Additionally, Trade Scouts may offer job post templates, but by using them, you adopt them as your own and are responsible for making them true, appropriate, and compliant with all applicable laws.

Screening Tools

Trade Scouts provides screening tools, including screener questions, phone screen tools, and assessments, for Employers and Staffing Agencies to use in their hiring process, and Employers and Staffing Agencies are solely responsible for the substantive questions they ask and for ensuring compliance with applicable laws. Assessments are only designed to evaluate particular skills and abilities and do not evaluate a Job Seeker's qualification for a job, and Employers and Staffing Agencies must use them in combination with other selection and hiring processes to measure only job-related knowledge, skills, abilities, and characteristics. Employers and Staffing Agencies are responsible for complying with anti-discrimination laws and providing reasonable accommodations to Job Seekers with disabilities.

Trade Scouts may direct Job Seekers who request accommodations to Employers via the contact information provided by the Employer, and Employers are responsible for monitoring their inboxes for such requests.

Background Check Services

Personal Background Checks Uploaded by Job Seekers

Personal background checks may be purchased and ordered by Job Seekers from Trade Scouts’ third-party background check Affiliate, and Job Seekers may voluntarily choose to upload their results to their Multimedia Portfolios. Personal background checks may include employment verifications that include safety records and job performance information, reference checks, and criminal background checks. Trade Scouts makes no guarantees and is not responsible for the accuracy of background check results. Job Seekers, Staffing Agencies and Employers agree to hold harmless Trade Scouts for any claims arising from the use or interpretation of Job Seekers’ personal background check results.

While Employers or Staffing Agencies may request that Job Seekers order and upload their background check results to their multimedia portfolios, Trade Scouts does not require Job Seekers to order or provide this information.

Background Checks Conducted by Staffing Agencies

In the event that an Employer engages with a Staffing Agency user on the Site and the Staffing Agency user provides background checks for an Employer, Trade Scouts is not liable for any circumstances or claims resulting from Employer or Staffing Agency’s use of background check information or results. If you use background checks provided by a Staffing Agency user or any other third-party background check vendor, you are responsible for complying with that Staffing Agency or vendor’s terms of service and for complying with the FCRA. Employers agree to hold harmless Trade Scouts for any claims arising from the use or interpretation of background check results provided by Staffing Agencies or any other third-party background check vendor.

Multi-Media Portfolio Reference Reviews

By using Trade Scouts, Job Seekers agree to provide one to three recent professional references (at least one of which must be a current or former reporting supervisor), including name, job title, and email address. Once the references are added to your Multi-Media Portfolio, automated reference check requests will be sent to your references, and they will be provided with a link to complete a questionnaire that captures your job duties, dates of employment, relationship to the reviewer, rehire eligibility, as well as their rating of your workmanship in a few different areas such as punctuality, reliability, work quality, teamwork, etc.

Communication through Trade Scouts

Trade Scouts may send messages or notifications as a courtesy regarding your or a Job Seeker's activity on the Site, but you should not rely on them, and it disclaims all warranties with regard to the transmission or storage of such courtesy notices. Trade Scouts may mask or hide contact information, such as phone numbers and email addresses, and substitute it with an alias.

If you communicate on or through the Site, you agree to the communication being processed, analyzed, reviewed, and stored for data analysis, quality control, and to improve the Site or any other Trade Scouts product or service.

Virtual Communications

Trade Scouts offers the option for Employers to manage virtual and remote communications with Job Seekers using Trade Scouts products, and such services may include scheduling, video conferencing, web conferencing, meeting rooms, and other collaborative services provided by third-party telecommunications service providers, but Trade Scouts disclaims all warranties with regards to the transmission of virtual communications. Employers are solely responsible for offering alternative methods of communicating or interviewing individuals with disabilities, and Trade Scouts assumes no liability for the misuse of any data shared or transmitted during virtual interviews.

Trade Scouts offers the option to manage virtual and remote communications with Job Seekers within Trade Scouts products, including but not limited to Virtual Interviews. You understand that Trade Scouts is not responsible for securing or protecting any data or information you share or transmit during your use of Virtual Interviews and that you are responsible for any requests for accommodations from Job Seekers.

Employers may have the option to enable recording of Virtual Interviews, but they must obtain consent from Job Seekers and all participants and comply with all applicable laws. Employers can use the information obtained through Virtual Evaluations only for internal hiring purposes and are responsible for ensuring compliance with record retention requirements.

HR Management Services

Trade Scouts may provide HR management software tools to Employers and employees, but the use of such tools is subject to the terms of the agreement, and Trade Scouts does not provide legal advice or guarantee compliance with the law.

Dispute Resolution

If you are in the United States, you give up your right to a jury trial for any legal disputes related to your use of the Site or these terms of service. If a suit is brought against Trade Scouts and users need to pursue any legal actions, you will need to settle the suit in Baltimore County, MD. This may involve traveling at your own expense to Baltimore County, MD, to proceed.

Class Action Waiver

By using the Site, you acknowledge that Trade Scouts can only offer you these services under the terms and conditions presented and agree not to sue Trade Scouts as a class plaintiff or representative in any class-action lawsuit regarding your use of the Site, but this does not limit your rights to bring an individual lawsuit. If a suit is brought against Trade Scouts and users need to pursue any legal actions, you will need to settle the suit in Baltimore County, MD. This may involve traveling at your own expense to Baltimore County, MD, to proceed.

Indemnification

This section outlines that the user agrees to indemnify, defend and hold harmless Trade Scouts, its agents, affiliates, and licensors from any claim or liability arising out of or related to their use of the Site or any Trade Scouts product or service, including any violation of applicable laws or regulations, third-party rights, or any claim that their content caused damage to a third party and that this obligation will survive their use of the Site.

Terms of Service for All Authorized Users

When you access or use the Site, you agree to the terms and conditions of this Agreement. You agree that Trade Scouts may perform the activities described in this Agreement, and you acknowledge that otherwise, the Site cannot work as intended.

You agree not to submit or post any commercial communications to the Site. Using the Site for commercial communications is a violation of this Agreement.

If you disagree with any part of this Agreement or you do not wish to authorize the activity it describes, do not use the Site. You agree you have read and acknowledge Trade Scouts Cookie Policy and Privacy Policy.

When You Use Our Site

By using Trade Scouts, users agree to allow Trade Scouts to collect, record, process, analyze, and store all activities, interactions, and communications on the Site, including those in private browsing modes, and may conduct tests without notice, and may offer suggestions or information without warranty or liability for user decisions or actions. The availability of Trade Scouts services may differ by location.

User Content

Trade Scouts allows users to post content or data such as job ads, Multimedia Portfolios, reviews, information, text, images, audio, video, messages, and other materials, and any data that a user or other party submits, posts, publishes, displays, or makes available on or through the Site, or otherwise provides to Trade Scouts, is called “User Content,” which must comply with the Site Rules and must not contain discriminatory slurs, proprietary information, trade secrets, intellectual property of another person, confidential information, spam, or harmful content.

If the User chooses to post official identification information on the Site, the User does so at their own risk and acknowledges that Trades Scouts is not responsible for preventing identity theft. By submitting any User Content, they agree that it may be publicly visible on Trade Scouts Site and that Trade Scouts is not responsible for such content. Trade Scouts may monitor and screen User Content and take action against accounts associated with violating the terms of the agreement.

Trade Scouts has the right to disclose User Content to third parties for various reasons, and Trade Scouts is not obligated to host or remove any particular User Content.

By using Trade Scouts, you accept that Trade Scouts will have third-party publishers and advertisers on its site (e.g., to make Job Seekers and Employers aware of local tool rental options). You also accept that our third-party publishers may cross-advertise Trade Scouts services on their sites, which could include and impact your information.

Trade Scouts may offer an incentive program for Job Seekers in partnership with third parties. When Job Seekers interact with the site (e.g., fill out their Multimedia Portfolio, update it, add pictures), they may receive cashback rewards for use with our partners. Employers may also receive similar cashback rewards for interacting with the site.

Civil Liability

The U.S. Communications Decency Act states that interactive computer service providers or users cannot be held liable for acting in good faith to restrict access to objectionable material or enabling others to restrict access to such material.

License to User Content and Feedback

By providing User Content, you grant Trade Scouts a non-exclusive, perpetual, fully paid, transferable, sublicensable license to use it for the purpose of publishing on the Trade Scouts website, maintaining or improving the website, and promoting Trade Scouts without compensation, and you also grant a license to use your name, user name, and/or trademarks in connection with the User Content.

When providing User Content, you represent and warrant that you own it or have the right to grant the license, it won't violate applicable laws or the rights of any person, and you agree to defend, indemnify and hold harmless Trade Scouts and its affiliates from any resulting claims; you may provide Feedback about Trade Scouts or the Site at your discretion, and if you do, you grant Trade Scouts a nonexclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable right and license to use it for any purpose without restriction.

Trade Scouts Site Rules

When using the site, do not:

  • Access the Site other than through the web or app interface publicly provided by Trade Scouts or otherwise access systems without express authorization.
  • Provide any false, fake, or fictitious information.
  • Provide any code or data with the intent or effect of damaging, disrupting, disabling, harming, impairing, interfering with, intercepting, expropriating or otherwise impeding, the Site or any data, program, system, equipment or communication, or that would cause a violation of any applicable law.
  • Access any data, especially personal data, without permission.
  • Bypass any limitations or suspensions of functionality.
  • Interfere with others’ use of the Site.
  • Modify, adapt, translate, reformat, resell, frame, or reverse engineer any portion of the Site.
  • Remove any copyright, trademark or other proprietary rights notices.
  • Harm anyone or violate the rights of anyone, including the right of publicity, right of privacy, or intellectual property rights.
  • Provide false information.
  • Transmit or store biometric information or biometric identifiers.
  • Promote or encourage illegal activity.
  • Promote pyramid schemes, multi-level marketing (MLM) programs, jobs that require payment to start, or any topics we consider detrimental to our users.
  • Send unsolicited commercial messages, or any other unlawful communications.
  • Imitate or impersonate another person, or create false accounts.
  • Send messages to users who have asked not to be contacted.
  • Sell personal data.
  • Trade Scouts reserves the right to monitor all activity on the Site and not deliver any malicious or unwanted messages, while users may not use or exploit the Site for commercial gain, scrape data, or violate any of Trade Scouts' rules or applicable laws and represent warrant, and covenant not to be located in any restricted countries or lists.

Accessing External Sites

Trade Scouts provides links to external sites but is not responsible for their availability or content, and any transactions you make with third-party sites are at your own risk. If you use a third-party service linked to Trade Scouts, you are contracting directly with the third party, and Trade Scouts is not responsible for any claims arising from using their services.

Creating and Accessing Your Trade Scouts Account

To use some parts of the Site, you may need to register and provide accurate information. Trade Scouts recommends enabling two-factor authentication and is not liable for the security of your account or the accuracy of any security notices it sends.

Your Contact Information

Trade Scouts may contact you through various means, including email, telephone, or postal mail, and by providing your phone number, you agree to receive calls and texts at that number, which you can opt out of at any time by replying STOP or managing your email preferences on your Trade Scouts account. However, Trade Scouts cannot be responsible for third parties to whom you have provided your phone number.

Disclaimer of Warranties

Trade Scouts may become unavailable without notice and could rely on third-party services, which could cause unexpected malfunction or unavailability. Trade Scouts disclaims any responsibility or liability for the accuracy, content, completeness, legality, reliability, operability, or availability of information or material displayed on the Site, and disclaims all liability for technical malfunctions or harm resulting from the use of the Site or Services.

Trade Scouts may limit or terminate services in specific countries or regions during times of war, political upheaval, epidemic, pandemic, riot, insurrection, national or regional emergency, terrorism or threat thereof, or civil disorder. The Site, its content, products, features, and services are provided "as is," with no warranties, and Trade Scouts disclaims any responsibility for any damages resulting from your use of the Site or from any actions, content, information, or data of third parties.

Limitation of Liability

Trade Scouts and its affiliates, as well as third-party licensors, are not liable for any damages resulting from a user's use, misuse, or reliance on the Site, including indirect, incidental, consequential, special, exemplary, and punitive damages, regardless of the cause, even if Trade Scouts was informed of the possibility of such damages. The maximum liability of Trade Scouts and its affiliates is limited to the amount the user paid to use the Site.

Infringement

The DMCA allows copyright owners who believe that material on the Internet infringes their rights to request that it be removed. The notice must include specific information, and if the person receiving the notice believes it has been filed wrongly, they can send a counter-notice.

Reservation of Rights

Trade Scouts or its affiliates or licensors own all proprietary rights associated with the Site, and you shall not modify any copyright or trademark notices or use any materials for any unauthorized purposes, including data mining or framing.

Miscellaneous

This agreement constitutes the entire agreement between you and Trade Scouts and supersedes all prior or contemporaneous agreements; if the Job Seeker, Employer, or Publisher Terms apply, those terms will control in case of any inconsistency, and any provisions of this agreement found unenforceable will be reformed to remain in effect, and Trade Scouts may provide the site and services only as an information service provider.

Ad Program Terms and Trade Scouts Ads

The Trade Scouts Ads Program terms (“TSAP Terms”) are incorporated into the Trade Scouts Terms of Service and apply to Employers and Staffing Agencies who use any aspect of the program, including job ads, Employer or Staffing Agency branding ads, or virtual hiring events, and by accepting these terms, Employers and Staffing Agencies agree to abide by them.

The use of Trade Scouts Ads Program (TSAP) is subject to Trade Scouts's policies and terms, including the Privacy Policy, which may be modified at any time. Employers or Staffing Agencies who post, edit, or claim job advertisements through the program are solely responsible for the content, target URLs, and other User Content included in the job ad. They are also responsible for any services or products advertised in the job ad.

The TSAP allows Employers and Staffing Agencies to place job ads, Employer or Staffing agency branding ads, or ads for virtual hiring events on Trade Scouts Property or Other Sites, and Employers and Staffing Agencies are solely responsible for their ad content and the services and products they offer. Trade Scouts makes no guarantees regarding the reach, performance, placement, or distribution of ads on Trade Scouts or Other Sites, and ad placement is at Trade Scouts' discretion. Employers and Staffing Agencies should know that Other Sites may collect or receive information about their job ads and performance.

Trade Scouts charges for the advertising of sponsored job ads and manages the visibility of the job ads on the Site and Other Sites. The management of job ads is at Trade Scouts' discretion and is provided without warranty, and the pricing metric may differ between job ads. The charge for Ads or multi-media portfolios may vary based on factors such as supply and demand, job title, and location.

By sponsoring, editing, claiming, or posting a job ad on Trade Scouts, you authorize Trade Scouts to reformat, display a snippet of, and host (but not change) the job ad on a Trade Scouts hosted page or Other Sites as it sees fit, and agree to this activity for all of your job ads. If you indicate that you want to fill your role in a short timeframe, Trade Scouts may add a label to your job ad, and you agree that Trade Scouts may estimate the compensation associated with any job ad and display it to Job Seekers. Trade Scouts may require sponsorship to display any job ad at any time and may recommend or suggest a budget to maintain or optimize its visibility.

Trade Scouts may offer Employers the opportunity to be a Featured Employer, which is at Trade Scouts' sole discretion and generally depends on the number of Ads and amount spent on Trade Scouts.

Trade Scouts may include Employer branding ad services as part of the services provided to Employers who sponsor a job ad and may also offer the ability to pay for such services. Employer branding ads may appear on the Site and on Other Sites. When using Trade Scouts Hiring Events, Employers are responsible for all aspects of the event, including the job listing or job ad content, screening questions, handling and safeguarding Job Seeker information, and accommodating Job Seeker requests or needs during the interview or application process.

Cancellation

Employers can cancel their Ads (job ad or Hiring Event) at any time, but they are responsible for paying all charges resulting from posted advertisements during the time period before the cancellation. If Employers cancel a Hiring Event, they will still be billed for the subscription plan they selected on the Site. Trade Scouts may modify or cancel the TSAP or TSAP Terms at any time, and certain sections will survive any expiration or termination of these Trade Scouts AP Terms. Failure to cancel your subscription at least one week prior to the end of the initial contract term will result in an automatic renewal of the existing plan, which may be subject to a future price increase (see Charges and Pricing).

Prohibited uses

Employers and Staffing Agencies are not allowed to generate fraudulent impressions or clicks or circumvent reporting of applications or advertise anything illegal in any state or country where their Ad is displayed. Violation of these policies can result in immediate termination of their account without notice, and they may be subject to legal penalties and consequences. Trade Scouts may reject or remove any Ad, and its decision is final and not subject to review. Trade Scouts may also require some job ads to be sponsored to verify their legitimacy, prevent abuse of the free-to-post system, improve services, or for any other reason in Trade Scouts' sole discretion.

Disclaimer and limitation of liability

The provision of the Program and the Site is "as is" and "as available." Trade Scouts and its affiliates and their third-party licensors disclaim all warranties and guarantees, including for title, non-infringement, service quality, merchantability, and fitness for any purpose. Except for amounts payable and any breach by you, to the fullest extent permitted by law, neither party will be liable for any consequential, special, indirect, exemplary, punitive, or other damages.

Payment

Trade Scouts does not collect, store, or transmit pay card data or bank account information, and our Site does not process payments. You provide your payment information directly to our third- party payment processing vendor, and Trade Scouts does not have access to your pay card or bank account information. Charges and Pricing

You shall initially be charged in accordance with the pricing listed onthe Site at the time that you sign up for an account with Trade Scouts.In order to continuously provide you with the best possible product and service, we may need to reevaluate our pricing from time to time. With prior written notice, Trade Scouts may issue periodic rate increases. Rate increases take effect on the first bill following the automatic renewal of your subscription. If you have any questions about your pricing or payment procedures, please refer to your contract or contact Trade Scouts.

Indemnification

Employers and Staffing Agencies are responsible for indemnifying, defending, and holding Trade Scouts harmless against any third-party claim or liability arising from their use of the TSAP, job listing, User Content, Hiring Event, and breach of the Trade Scouts AP Terms.

Job Multimedia Portfolio and Posting Search Program Terms

The Trade Scouts Multimedia Portfolio Search Program Terms are part of the Trade Scouts Terms of Service and apply to any Employer using the Trade Scouts Multimedia Portfolio Search offering, and agreeing to these terms also means agreeing to the Trade Scouts Terms of Service.

The use of the Trade Scouts Multimedia Portfolio Search Program is subject to applicable Trade Scouts guidelines and policies, and the pricing and offerings of the Program may change, with the purchase of additional subscriptions or plans potentially resulting in pro-rata charges. Employers must only use information obtained from the site for internal use and filling job listings and are prohibited from using the Program for illegal, discriminatory, or fraudulent purposes, as well as extracting multimedia portfolio information to circumvent the Job Seeker contact system.

The Trade Scouts Multimedia Portfolio Search Program allows an Employer to access Multimedia Portfolio Owner’s email address or connect with them via phone call to facilitate contact with potential employees; however, the use of the program is subject to all Trade Scouts Site Rules and policies, and the user must comply with Telephone Consumer Protection Act “TCPA” guidelines and other laws governing phone or mobile communications. The program may not be used in a spam-like manner, and any other uses of the Trade Scouts Multimedia Portfolio Search Program are not permitted, including scraping the Trade Scouts Multimedia Portfolio Search database or using it for any purpose except as allowed.

The information in any and all Multimedia Portfolios may not be accurate or verified by Trade Scouts, and any filtering or ranking tools rely on self-reported information from Multimedia Portfolio Owners. Trade Scouts does not guarantee that using the program will result in desirable search results or matches, and it is the user's responsibility to verify any information provided by Multimedia Portfolio Owners.

Trade Scouts’ Right to Cancel

The use of the Trade Scouts Multimedia Portfolio Search Program cannot be revoked once a request has been made, and cancellation policies will apply when ending the use of the program; Trade Scouts reserves the right to cancel a subscription at any time and may update or modify the Program or Trade Scouts Multimedia Portfolio Search Program Terms without liability, with certain sections surviving termination.

Your information

The user must ensure that all the information provided to Trade Scouts is accurate and up to date and represents to Trade Scouts that they are an Employer interested in considering the Multimedia Portfolio Owner for employment.

Disclaimer

The provision of the Program and Site by Trade Scouts is "as is" and "as available," and Trade Scouts disclaims all warranties regarding the validity of email addresses, delivery and recipient response, availability and accuracy of multimedia portfolios, and other warranties. Except for certain payment obligations, Trade Scouts and the user waive all liability for consequential, special, indirect, and other damages, and Trade Scouts’ aggregate liability is limited to the amount paid for the Trade Scouts Multimedia Portfolio Search service giving rise to the claim.

The user shall defend, indemnify and hold Trade Scouts, its agents, affiliates, and licensors harmless from any third-party claim or liability arising out of their use of the Program, including any contact made with the recipient, email requests, phone calls or text messages, and activities of any third-party service provider used to facilitate sourcing activities through the Program, such as an Applicant Tracking System (ATS).

Assessments

Trade Scouts Assessments is an online tool that allows Employers to select and request responses from Job Seekers through the Site using assessments offered by Trade Scouts and/or third-party assessment providers.

Assessments

Trade Scouts Assessments is a tool for Employers and Staffing Agencies to request responses from Job Seekers through the Site. Once the Employer or staffing Agency requests an Assessment, it cannot be canceled, and the Employer or Staffing Agency is responsible for compliance with the law, including the Fair Credit Reporting Act and similar state statutes. Trade Scouts does not guarantee that Job Seekers will receive, access, read, or respond to any Assessment or that there will be no mistakes in the data transmission.

Employers and Staffing Agencies are solely responsible for selecting which Assessment to send to a Job Seeker and must use it in combination with other selection and hiring processes, not as the sole measure of a Job Seeker's fitness for a job. Sending an Assessment does not guarantee a response or further communication from the Job Seeker, and Trade Scouts reserves the right to change any Assessment or questions asked within an Assessment at any time.

Responses

Employers and Staffing Agencies understand that Job Seekers provide a response to assessments at their discretion and that they are the sole party to determine if a response indicates a qualified Job Seeker. Employers may instruct Trade Scouts to send rejection notices and decide whether to offer a Job Seeker an opportunity to retake an assessment or modify their response. Responses are expected to be used responsibly and legally as part of the hiring process and should be considered along with other relevant information.

Rules for use

As an Employer or Staffing Agency, you must not use Trade Scouts Assessments for any illegal, discriminatory, or fraudulent purpose or send any objectionable or irrelevant content. Employers and Staffing Agencies may not seek highly confidential personal information from Job Seekers via Trade Scouts Assessments. Employers or Staffing agencies who receive a Job Seeker accommodation request through Trade Scouts Assessments must provide an accommodation as required by law, and failure to do so will result in termination of your access to the Assessments tool. Trade Scouts has the right to exclude or remove any Assessment or Response from the Site.

The website’s role

Trade Scouts Assessments is a tool that enables Employers, Staffing Agencies, and Job Seekers to exchange assessments and responses, and Trade Scouts does not act as an employment agency in offering the tool. Employers, staffing Agencies, and Job Seekers are solely responsible for the content of any Assessment or Response, any decision to proceed or not to proceed with interviews or offers, and any issues arising from the use of Trade Scouts Assessments. Trade Scouts assumes no responsibility, and disclaims all liability for the accuracy, validity, completeness, legality, reliability, or availability of the Site, the Trade Scouts Assessments tool, and any Assessment or Response.

Confidentiality

By using Trade Scouts Assessments, you agree to keep all information you obtain confidential and use it in accordance with applicable privacy and data protection laws. You also agree not to disclose the names or identities of Job Seekers outside of your recruiting or hiring department and to take appropriate measures to protect the content you obtain from misuse or unauthorized access.

Disclaimer

Trade Scouts Assessments and all materials, information, assessment responses, products, and services available on or through Trade Scouts Assessments are provided on an "as is" and "as available" basis, with no warranties whatsoever, either express or implied. Trade Scouts expressly disclaims all warranties and does not guarantee that the Site or Trade Scouts Assessments will always be error-free, safe, or secure. Except for your breach of confidentiality or indemnification amounts payable hereunder, neither party will be liable for any consequential, special, indirect, exemplary, punitive, or other damages, and each party's aggregate liability to the other is limited to amounts paid or payable to Trade Scouts by you. Trade Scouts Assessments are not customized to the specific job requirements of your open positions, and Trade Scouts does not guarantee job-appropriateness of any Trade Scouts Assessment. Employers and Staffing Agencies must determine the suitability of a given Assessment for their job role and their Hiring Event.

Indemnification

By using Trade Scouts Assessments, you agree to defend, indemnify, and hold Trade Scouts harmless from any claims, damages, losses, liabilities, costs, or debt arising from your violation of the terms of the agreement, use of the Site, loss or disclosure of information, violation of applicable laws or regulations, violation of third-party rights, content that caused damage to a third party, or actions as an Employer or Staffing Agency, including hiring, screening, compensating, promoting, or demoting any employee or Job Seeker. You agree to pay Trade Scouts' reasonable attorneys' fees, court costs, settlements, and disbursements, and this defense and indemnification obligation will survive this Agreement and your use of Trade Scouts Assessments.

Termination

Trade Scouts may suspend or terminate Trade Scouts Assessments or your account at any time with or without notice, and you may terminate this Agreement by notifying Trade Scouts at any time and closing your account. Provisions of the Agreement, which by their nature should survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability, will remain in effect after termination.

API terms and conditions

The Trade Scouts API terms and documentation are part of the Trade Scouts Terms of Service and apply to anyone who accesses or uses an Application Programming Interface created or maintained by Trade Scouts, develops an application that communicates with any API, the Site, or any Trade Scouts service or otherwise accepts these API Terms. By accepting these terms, you agree to the Trade Scouts Terms of Service and policies, including the Trade Scouts Privacy Policy and Cookie Policy. Any capitalized terms that are used but not defined in these API Terms have the meaning set forth in the Agreement.

APIs

Trade Scouts may provide access to APIs and Documentation for your internal business use in developing and using Applications, subject to your compliance with the Agreement. You may develop an Application that interoperates with a Trade Scouts API for use by your employees or independent contractors for your internal business purposes, and your use of the API is subject to the applicable Terms of Service. Your license is revocable, non-exclusive, non-transferable, and non-sublicensable, and Trade Scouts reserves all rights that are not expressly granted by the Agreement. By using Trade Scouts' API, you agree that Trade Scouts may monitor your and End Users’ use of any API and may process and analyze submitted information and behavioral data in accordance with the Trade Scouts Privacy Policy. You also agree that Trade Scouts may use technical means to overcome any interference with its monitoring. Trade Scouts reserves the right to place limits on access to any API, monitor the usage of the APIs to enforce these limits, and periodically audit your usage. Trade Scouts may update or discontinue the API at any time and may require you to use the most recent version at your sole expense, and your use of an API after an update constitutes acceptance of the update; Trade Scouts also reserves the right to develop competing products or services.

Restrictions

The access and use of the Site or any Trade Scouts App through an API is subject to the Site Rules, these API Terms, and any additional rules, guidelines, and policies made available by Trade Scouts, and the users must comply with them, monitor their Application's use, restrict any End Users who violate the API terms, and notify Trade Scouts of any violation. You agree not to violate any Site Rule or applicable law and not to copy, modify or create derivative works of an API, and not to reverse engineer or access any source code component of an API. You also agree to provide accurate reporting of data obtained through the use of an API and to provide and adhere to a Privacy Policy that accurately describes how user information is collected and shared with Trade Scouts and other third parties. If you use any Trade Scouts API or Documentation to provide services to an Employer, you are not allowed to access personal data, and if you receive any such data from Trade Scouts that is not required, you must return or destroy it; if you and Trade Scouts agree to process personal data, you must agree to the terms of a Data Processing Addendum.

Access

To access an API, you agree to follow the registration and implementation process, including providing information about your Application and a current contact person. You must use a password, key, or other security device to access an API (“API Key”), which you are responsible for, and you will not share it with any third party or use it in non-compliance with these API Terms.

Intellectual property

In summary, Trade Scouts or its affiliates own all rights to the API, and you are not allowed to modify any copyright or proprietary legends on the materials accessed through the API. If you provide feedback or suggestions about the APIs, Trade Scouts may use such information without obligation to you, and you acknowledge that User Content may be available via the APIs and is the responsibility of the person who provided it.

Disclaimer

The Site, APIs, and Documentation are provided "as is," without warranties of any kind, and Trade Scouts and its affiliates, and third-party licensors expressly disclaim all warranties. You understand and agree that you access and use the Trade Scouts API at your own discretion and risk, and you will be solely responsible for any damages to your computer system or loss of data that results from such access or use. Except for amounts payable under Section 8 and any breach by you of Section 1, neither party will be liable under these API terms for any consequential, special, indirect, exemplary, punitive, or other damages.

Payment

Payment Information Privacy

Trade Scouts does not collect, store, or transmit pay card data or bank account information, and our Site does not process payments. You provide your payment information directly to our third- party payment processing vendor, and Trade Scouts does not have access to your pay card or bank account information. For more information on how our thrid-party payment processing vendor interacts with your personal and payment information, please refer to their privacy policy at https://stripe.com/privacy.

Charges and Pricing

Unless you have a separate agreement, you will be charged for your and your End Users' use of Trade Scouts App or Site according to their respective Terms of Service and payment information, based on Trade Scouts’ usage measurements, and it is your responsibility to keep updated on payment information and how Trade Scouts charges you.

Cancellation

You can cancel this agreement at any time by stopping your use of the APIs and deleting your application, but if you violate the agreement, Trade Scouts may terminate your API access or API key at any time without liability. After cancellation, you must delete your application, and Trade Scouts may notify any end user to provide notice of the cancellation of this agreement.

Indemnification

You are responsible for indemnifying, defending and holding harmless Trade Scouts, its affiliates and licensors from any third-party claim or liability arising out of your or End Users' API use, User Content, your Application, or breach of these API Terms.

Trade Scouts Hiring Platform Terms

The program

The Trade Scouts Hiring Platform is a product designed to automate recruitment processes and streamline hiring and employment decision-making processes, and users are responsible for complying with applicable laws and indemnifying Trade Scouts against any claims arising from their use of Trade Scouts Hiring Platform or similar products; by using Trade Scouts Hiring Platform, users are asking Trade Scouts to post job listings, manage ad campaigns, add screening tools, and send information provided by Job Seekers who RSVP to the user's events.

The Trade Scouts Hiring Platform is a service that provides tools for job listings, recruitment events, and communication services, but you are responsible for complying with all applicable laws, providing the necessary accommodations for Job Seekers during the interview process, and protecting Job Seeker information. You grant Trade Scouts the license to use your name, username, trademarks, and logos in connection with any user content or marketing materials, and you agree that Trade Scouts may collect demographic data from Job Seekers but you do not have the right to access such data without their permission. Trade Scouts may offer virtual and remote communication services through third-party providers, but you acknowledge that Trade Scouts is not responsible for the quality or availability of these services.

Cancellation

You can cancel any job listing or job ad at any time, but if you cancel an Event, Trade Scouts will still bill you in accordance with the pricing and any platform fee agreed upon. Trade Scouts may cancel the Program or modify these terms at any time, and certain sections of the terms will survive any expiration or termination.

Prohibited uses

In summary, you are prohibited from advertising anything illegal or engaging in any fraudulent activities. You must provide correct and current information, and grant Trade Scouts and its partners the right to copy, distribute, and display your job listings or ads. Violation of these policies may result in immediate termination of your account, and Trade Scouts or its partners may reject or remove any job listings or ads.

Disclaimer

The Program and Site provided by Trade Scouts are "as is" and Trade Scouts disclaims all warranties, including for non-infringement, title, service quality, merchantability, and fitness for any purpose. You use the Program and Site at your own risk, and Trade Scouts does not guarantee uninterrupted, error-free, safe, or secure access. Trade Scouts disclaims all guarantees regarding position, rates, delivery of impressions, interest, and quality of attendees at your Event(s). Neither party will be liable for consequential, special, indirect, exemplary, punitive, or other damages under these Trade Scouts Hiring Platform Terms.

Payment

Trade Scouts does not collect, store, or transmit pay card data or bank account information, and our Site does not process payments. You provide your payment information directly to our third- party payment processing vendor, and Trade Scouts does not have access to your pay card or bank account information. Charges and Pricing

Employers and Staffing Agencies using the Trade Scouts Hiring Platform will be charged for their selected subscription plan(s) in accordance with the pricing listed on the Site. Charges are exclusive of all taxes, including VAT, and you are responsible for all taxes as applicable and appropriate. Trade Scouts reserves the right to suspend or terminate your use of its products if you have an unpaid or outstanding invoice or account balance for any Trade Scouts product.

Affiliate Acceptable Use Policy

General

The Affiliate Acceptable Use Policy applies to affiliates of Trade Scouts who use Program Elements, including job search results and pay- per-portfolio clicks. As a publisher, you are responsible for complying with all applicable laws.

Restricted Websites

Affiliates cannot publish or link Program Elements from websites that are incomplete or non- functioning, contain infringing material, promote illegal goods or services, violate applicable laws or Trade Scouts' Site Rules, engage in harmful activities, or contain pornographic, obscene, defamatory, violent, or hate-oriented material.

Location and Delivery of Program Elements

Affiliate is limited to serving one Program Element per web page unless authorized by Trade Scouts and should not serve Program Elements on pages with minimal content or on pages created solely for showing ads. Affiliates must not serve Program Elements on downloadable software, software that triggers pop-ups or redirects, or websites not directly controlled by the Affiliate. Additionally, any use of Trade Scouts API by an Affiliate must comply with the guidelines set by Trade Scouts.

Prohibited activities

The Affiliate shall not modify, label, or place notices in proximity to the Program Elements without Trade Scouts' written consent. They shall not engage in any fraudulent means to draw clicks or impressions, artificially inflate the volume of impressions or clicks, or provide incentives to encourage clicks or use of Program Elements. The Affiliate shall not use frames, redistribute job search results, or store any job search content.

Security

Affiliates who receive a password, API key, or other security device from Trade Scouts to access Program Elements or any non-public area of the Trade Scouts website or system must maintain the confidentiality of that information and not share it with any third party or use it for unauthorized purposes.

Cooperation

Trade Scouts will collaborate with law enforcement and other authorities to investigate illegal activity or suspected illegal activity that fraudulently inflates the volume of impressions or clicks. Affiliates must cooperate with Trade Scouts in any corrective action necessary to prevent impermissible use of the Program Elements by providing all necessary information to investigate suspected violations.

Foundational Privacy Principles

First, we’ll talk about a few quick principles that are the foundations of our Privacy Policy at Trade Scouts.

All information you add or upload to your Trade Scouts Multimedia Portfolio will be shared with anyone visiting your Trade Scouts Multimedia Portfolio, including Employers, Staffing Agencies and Third Parties.

Your Phone number and email address, which are necessary for creating and maintaining an account, will be shared with users who visit the site and pay for your contact information. At any time, you may revoke access to your contact information (See the “Your Rights” section of this Privacy Policy)

We will not give any personal information you share with Trade Scouts to anyone else, unless we have a very good and serious reason to do so – for example, complying with the law. We will let you know if this is ever the case.

We have built our job board and multimedia portfolio Builder to give you as much control as possible regarding what other people see. If you ever wish to turn off your multimedia portfolio permanently, you can do so at any time.

Foundational Communication Principles

When you sign up as an Employer, Staffing Agency or Job Seeker through Trade Scouts, we do ask for a valid email address and phone number.

After the initial setup and identity verification process, we may contact you from time to time. Here are some of the types of notifications you may receive:

  • Job notifications – notifications about jobs you might like as a Job Seeker, or digests containing information about several jobs you might be interested in
  • Multimedia portfolio notifications – notifications about multimedia portfolios that may match with jobs you have posted as an Employer
  • Blog notifications – notifications that tell you when we have posted a blog on our site
  • Website-related emails – notifications that occur specifically when you interact with our website, e.g., if you perform a password reset

We may also send out periodic newsletters when we update the site, roll out new features, or have other pertinent information to share. You can opt out of any of the above notifications at any time. To do so, click the unsubscribe link in the footer of the email, or text the word “STOP” in reply to any of our texts.

How Trade Scouts Protects Visitor Information

Non-Identifying Information

Trade Scouts collects information about its website visitors that is non-personally identifying. Examples of this type of information include the type of browser a visitor uses, the language they prefer, the site the visitor was on immediately before Trade Scouts, and the date and time the visitor accessed Trade Scouts.

This type of information is collected by most companies that own and operate websites. Trade Scouts collects this information simply to understand how visitors access and use Trade Scouts. We may use this information to create reports about our usage trends, and we may share those reports, but all information will be de-identified and discussed only in the aggregate.

  • When Job Seekers choose to upload documents, photos, and files to their Multimedia Portfolios, any sensitive information that candidates voluntarily provide, such as official forms of identification, background check results, etc.
  • When Employers post jobs, the information they provide may include locational information and other relevant details.

In any of these and similar circumstances, when Trade Scouts collect personal or potentially- identifying information, we only collect as much as is necessary to provide our services. We do not disclose this information except in the select circumstances we outline.

And, if a website visitor does not wish to give us this information, they do not have to.

How Trade Scouts Handles Potential Disclosure and Release of Visitor Information

We will only disclose any personally-identifying information (or potentially personally-identifying information) to our employees, contractors, and third parties specifically affiliated with our site. We will only provide that disclosure if it is needed to fulfill a specific job requirement and only if the parties receiving that information agree not to further disclose the information to any other parties.

When you use Trade Scouts, you agree to that potential disclosure or transfer of information.

The other circumstances under which Trade Scouts will disclose any personal information are rare, but do exist. These circumstances include if Trade Scouts needs to respond to a governmental request, court order, or subpoena, or otherwise needs to act to protect the interests of Trade Scouts, protect the public interests, or protect third parties from substantial risk.

If website users interact with our services or our staff and, in doing so, supply information – e.g., filling out their Trade Scouts multimedia portfolio, posting a job opportunity, sending us a support email, or filling out a survey – we reserve the right to use that information. We will only use the information to support better use of our site, supply material for promoting and marketing our site, support other users, or respond better to your requests. This may involve disclosing the information or publishing it under certain circumstances.

Trade Scouts will take reasonable measures to protect the site and its users or visitors from unauthorized access to (or use, or destruction, or alteration of) all submitted and collected information. Trade Scouts may release information that job Job Seekers provide to Employers or Employer representatives. Trade Scouts may release information that Employers provide to Job Seekers. We will facilitate this transfer of information to fulfill the services provided by our site.

Trade Scouts is not liable if your personal information is released by a third party if that release is associated with a fraudulent or criminal act, or if the release is associated with your use of another job board site that may have a cross-posted job listing on our site.

Finally, if Trade Scouts and its assets are acquired in the future, any retained user information may be part of this acquisition. If this happens, Trade Scouts will update its Privacy Policy and send more information to its users at this time.

What Trade Scouts Does with Visitor Information

After registering with Trade Scouts, we do ask for personal information – including but not limited to your name, your company’s name, your employment history, your general location, and your communication information. You do not need to give this information to Trade Scouts, but using our site properly may require the use of at least some of this information.

We use this information to provide job-matching services, recruitment services, and job board services through our site. We will communicate with you about your job posting, Trade Scouts multimedia portfolio, or application progress. We will also communicate with you to review any services we have provided for you, with the intent of learning how to provide better services. If you would like to opt out of receiving notifications or communications from our site at any time, you can unsubscribe from our mailing list or text “STOP” to any phone number associated with our site from which you receive alerts.

When you use or register with Trade Scouts, you consent to these policies and procedures regarding the use of information. You should also be aware that the personal information you post through the site, including any employment or personal information, can be accessed and viewed by others who use the site. You provide this information voluntarily. Trade Scouts is not responsible for any third-party interactions that occur based on the information you voluntarily provide. We also do not have any control over unsolicited third-party messages you may receive based on the information you voluntarily provide through Trade Scouts, and we do not have any responsibility for the results of those interactions.

Your Rights

Data Erasure

  • We may retain your personal information as necessary for our legitimate business interests, such as the prevention of money laundering, fraud detection and prevention, and enhancing safety. For example, if we suspend an Account for fraud or safety reasons, we may retain information from that Account to prevent you from opening a new Account in the future.
  • We may retain and use your personal information to the extent necessary to comply with our legal obligations. For example, We may keep information for tax, legal reporting, and auditing obligations.
  • Information you have shared with others (e.g., Reviews, forum postings) may remain publicly visible on Our site even after your Account is canceled.

Trade Scouts provides instructions on how to exercise these rights on our Your Rights page and the option to broadcast the Global Privacy Control signal on supported browsers. California residents also have certain rights under the "Shine the Light" law, which allows them to opt out of disclosing their personal data to third parties for direct marketing purposes.

Under the California Consumer Privacy Act (CCPA), Trade Scouts will not sell or share any Client Personal Data, retain, use, or disclose any such data for any purpose other than the business purpose(s) specified in the Agreement, and will provide the same level of privacy protection required of the Client by the CCPA. Trade Scouts will notify the Client if it can no longer meet its obligations under the CCPA and will work with the Client to take reasonable and appropriate steps to stop and remediate unauthorized use of Client Personal Data.

Changes To This Privacy Policy

We reserve the right to modify this Privacy Policy at any time in accordance with applicable law. If we do so, we will post the revised Privacy Policy and update the “Last Updated” date at the top. When we make material changes, we will also provide you with notice of the modification by email at least thirty (30) days before the effective date. If you disagree with the revised Privacy Policy, you can cancel your Account. If you do not cancel your Account before the date the revised Privacy Policy becomes effective, your continued access to or use of Our Platform will be subject to the revised Privacy Policy.

How to deactivate your account

When you deactivate your account, any current job application or search with us is deemed automatically canceled by you, subject to clearing any outstanding balance due, if applicable. If, in the future, you want to reopen a deactivated account, you’ll need to contact us.

Job Seekers: To deactivate your jobseeker account, you may go to your Personal Information page, select “Manage a Different Page”, then select “Work Status” in the dropdown menu, and then Select “No” for the question “Would you like your portfolio to be active for prospects to view.”

How to delete your account

"Required Field" data such as name, phone number, address, and email address cannot be deleted by account holders directly. Users wishing to delete either required field information or their entire account must email us at [email protected] with "Account Deletion Request" in the subject line.

How to get a copy of your account data

You can always review and copy your account information by logging into your account and printing or taking a screenshot of the webpage with the desired information. You can also submit a request for a copy of your account data by emailing us at [email protected] with "Copy of Account Data Request" in the subject line.

Right to portability

In certain jurisdictions, the applicable law may allow you to receive a copy of the personal information you have provided to us.
